Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights consist of:- Pay for all earnings made (INFO # 3) at the rate agreed to by the employer and employee.
– Pay of a minimum of base pay (INFO # 1), the relevant Colorado or regional base pay, and all earned overtime wages without impermissible deductions from their incomes;.
– Pay of all made incomes without impermissible reductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS implements much of Colorado’s wage and hour and other types of labor statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules webpages for existing and previous variations of crucial Colorado labor statutes and guidelines.
Published Guidance: The Division’s primary types of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially approved notices, viewpoints, and descriptions on numerous labor law topics; and.
– KNOWLEDGEs (Knowledge for employment Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If a company owes you wages, you can send your company a composed need for payment of salaries by mail, email, text message, or other electronic ways. A written need might be sent out to the company at the exact same time a Labor Standards Complaint Form for overdue salaries is filed with the Division. The Labor employment Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements webpage.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and evaluated, a letter explaining the nature of the grievance and the amounts declared to be owed is sent to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division might carry out employer-wide direct investigations of possible infractions of Colorado wage and employment hour law. If you would like to submit a pointer, please email the Division at cdle_di_tips@state.co.us. If you wish to file a specific claim for overdue wages, you must submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, employment and Settlements website. To appeal a direct examination citation or one or more Notices of Assessment, a supposed employer may submit a Direct Investigation Appeal Form.
